Payment Terms

For projects under AUD$2,000, payment in full is required before work commences.
For projects over AUD$2,000, a 50% non-refundable deposit is required before work commences, with the balance due prior to handover.

Invoices are due within 7 days unless otherwise stated. Late payments may incur interest at 5% per month, along with recovery and administration costs if external collection services are required. Work will not progress, and completed work will not be handed over, until all invoices are paid.

Scope

All services will be delivered in line with the agreed project proposal, quote or written scope. Any work requested outside of this scope, including additional pages, design changes, technical functionality or revisions, will be billed separately at the rate quoted at the time of request. A written agreement (email is sufficient) will be required to confirm any additional charges.

Revisions

I am committed to working with you to ensure you are satisfied with the design and development of your website within the agreed project scope. However, any requests that fall outside of the original project scope or involve substantial changes to the design or functionality may incur additional fees and will require a separate agreement.

Once the project is completed and approved by you, any further changes or new requests will be considered separate from the original agreement and may be subject to additional fees.

Delays

If delays occur due to circumstances beyond Miss Wix’s control (including illness, injury, fire, equipment failure or acts of God), you will be updated as soon as possible and offered a revised delivery schedule.

If delays occur due to the client not providing content, feedback, access or approvals within the agreed timeframe, the project timeline may be extended. If the delay exceeds 14 days, the project may be paused. If the delay exceeds 60 days, Miss Wix may invoice for work completed and terminate the project if necessary. Restart fees may apply.

Termination

If you choose to terminate the project for any reason, the deposit will be forfeited and you will be invoiced for work completed up to the date of termination. Miss Wix may terminate the project if you fail to provide required content or feedback, breach these terms, act inappropriately, or fail to make payments when due. In the event of termination, Miss Wix retains ownership of all work and design assets.

Refunds

Digital Products: All sales of digital products, including Wix templates, are final. Once a purchase is made and the product is delivered, no refunds will be issued.
Custom Website Design Services: Custom website design services are non-refundable once work has commenced. This includes all stages of design and development, from initial concept to final delivery. Once the work is complete and the website is live, no refunds will be given for any reason.

Intellectual Property

All designs, drafts and deliverables remain the property of Miss Wix until full payment is received. Once final payment is made, ownership rights to the final design are transferred to you. Working files, design assets and drafts not included in the final site remain the property of Miss Wix. Miss Wix may display completed work in portfolios, advertising or marketing, unless otherwise agreed in writing.

Privacy

Miss Wix respects your privacy and handles personal information in accordance with Australian privacy law. Your information will be used only to deliver services and will not be shared with third parties except where required by law or necessary to complete work.

Client Responsibilities

You are responsible for providing all required content, images and information within the agreed timeframe. Delays in providing content, approvals or feedback may extend the project timeline. You are responsible for ensuring all content provided is accurate, lawful and does not infringe any copyright or intellectual property rights.

Communication

Clear and timely communication is essential for the success of your project. We will communicate regularly through email and scheduled calls to discuss progress and address any questions or concerns you may have.

Confidentiality

Both parties agree to keep all project-related information confidential and not disclose it to any third party without prior written consent.
